IS JUDGE JOHN TOSHO FOR BUHARI OR JUDICIARY?

The leader of the Indigenous People of Biafra, Nnamdi Kanu, on Friday (29th of January) was denied bail by a Federal High Court, sitting in Abuja, presided over by Justice John Tosho. Tsoho denied Kanu’s application on the grounds that he was a threat to national security and there was a high possibility of Kanu committing the same offence and also jumping bail, owing to his dual citizenship.
He ordered that Kanu be remanded in prison custody. It was so much anticipated that Nnamdi Kanu was to be granted bail on the 29 of January, been that every charges laid against was drop and cancelled, but Judge John Tosho denied him bail, on a laughable excuse that he had a dual citizenship. Well, before Judge Tosho read out his reasons for not granting Nnamdi Kanu bail, a very close and reliable source made it known to us that Nnamdi Kanu was going to be denied bail, been that President Mohammdu Buhari has offered the presiding Judge (John Tosho) N100million.
We thought it was a joke, but the manner that which Judge Tosho denied Nnamdi Kanu bail, showed that he was for BUHARI and not The JUDICIARY. John Tosho, knew before time that there wasn't a chance of him granting Nnamdi Kanu bail, instead he wasted our precious time in court reading out Nonsensical allegations and his so-called facts, as to why he wasn't going to grant Nnamdi Kanu bail. President Buhari is making sure Nnamdi Kanu is not granted bail but instead jailed at the process of his trials.

Judge Tosho actions in court on the 29th of January didn't represent the law or the judiciary; instead it represented a man who was speaking for Mohammdu Buhari. Buhari who is so keen on making sure Nnamdi Kanu is jailed for life, is making sure he pressure Judge Tosho into doing his bidding. John Tosho, as judge is supposed to conduct the trial impartially and not been biased. A judge hears all the witnesses and any other evidence presented by the barristers of the case, assesses the credibility and arguments of the parties, and then issues a ruling on the matter at hand based on his or her interpretation of the law and his or her own personal judgment. Judges manage the legal process and oversee court proceedings to ensure that they are fair and follow the law, but in Nigeria it always seem as if most Judges work for the president of the country instead of representing the law and Justice they were meant to uphold. Judges ought to do a lot of reading and research.

They must research laws and case histories relevant to the cases before them, and they must stay current on changes to the law. In addition, they must read and evaluate evidence, motions and records specific to the cases they are hearing. Judges must be able to take in all of the relevant research, evidence and testimony and apply them to cases in court. Judge John Tosho needs to prove to the judiciary, that he stands with the law and justice, he represents and not as a spokes man of president Buhari, who is hell-bent on making sure Nnamdi Kanu goes to jail for a crime he did not commit. The trial continues on the 9th, 10th,11th of February, judge Tosho who is still the presiding Judge should make sure he enforce the rules of the court and hear arguments from attorneys, receive and review evidence and listen to the defendant without been biased. Throughout the trial, judge Tosho must make accurate rulings on whether evidence or testimonies are admissible and relevant to the trial. Throughout the entire judicial process, judge Tosho must remain impartial. He must put aside all personal feelings and beliefs and make all rulings and decisions based on the evidence and relevant laws. He must stand for justice and law, not a representative of Muhammdu Buhari.Judge John Tosho needs to understand that if he goes against what's right and just, he and he alone will bear the consequences, its better he quits now if he knows he's not capable of delivering the right justice.
